By accessing or using The Prompt Fixer™ ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

The Prompt Fixer™ provides AI-powered prompt optimization tools designed to help users create more effective prompts for AI assistants. The Service includes both free and premium subscription tiers with varying levels of access and features.

Free Tier: Limited daily AI-powered generations, unlimited standard mode
Pro Tier: Increased monthly AI-powered generations, prompt history sync, priority support

3. AI Tool Role and Neutrality

The Service provides automated prompt-formatting and optimization tools that operate based on user input. The platform does not review, approve, endorse, or determine the appropriateness, legality, or accuracy of user prompts or generated outputs and does not provide professional, legal, medical, or regulatory advice.

4. User Accounts

Account creation is optional for basic features. When you create an account, you must provide accurate information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

5. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, or harassing
Violate any applicable laws or regulations
Infringe upon intellectual property rights of others
Attempt to bypass usage limits or gain unauthorized access
Transmit viruses, malware, or other malicious code
Engage in any activity that interferes with or disrupts the Service
Use automated systems to access the Service without permission
Generate content intended for phishing, fraud, or deception

6. Intellectual Property

Our Content: The Service and its original content, features, and functionality are owned by The Prompt Fixer™ and are protected by intellectual property laws.

Your Content: You retain ownership of any prompts you create. By using the Service, you grant us a limited license to process and store your content solely for the purpose of providing the Service. We do not claim ownership of your prompts or generated outputs.

Generated Outputs: The platform does not claim ownership of generated outputs. Users are solely responsible for determining whether outputs may be used, shared, or protected under applicable intellectual property or other laws.

7. Subscription and Billing

Premium features require a paid subscription processed through Stripe. By subscribing, you agree to:

Pay all applicable fees at the prices in effect when charges are incurred
Automatic renewal unless cancelled before the renewal date
Provide accurate billing information

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

8. Data Processing

We process your data in accordance with our Privacy Policy. By using the Service, you acknowledge that your prompts are processed by OpenAI to provide optimization. For logged-in users, prompt history is stored in our database. See our Privacy Policy for full details.

Third-Party AI Systems: The Service may rely on third-party AI systems to process prompts or generate outputs. The platform does not control the behavior of such systems and does not guarantee the accuracy, completeness, or suitability of their outputs.

9. API Terms & Conditions

9.1 API License

Limited, non-exclusive, non-transferable license to access our API, subject to:

Compliance with Terms and Acceptable Use Policy
Payment of applicable fees
Your subscription tier limits

9.2 API Changes

Breaking changes: 90 days advance notice
New features: Added anytime
Deprecation: 180 days notice minimum
Version support: Previous major version supported for 1 year

9.3 Service Level

Uptime target: 99.9% (excludes scheduled maintenance)
Scheduled maintenance: Announced 7 days in advance
Free tier: No SLA guarantee
Enterprise: Custom SLA available

9.4 Rate Limits

Limits enforced per subscription tier
Exceeding limits returns HTTP 429 errors
Repeated abuse may result in suspension

9.5 Data Ownership

Your prompts: You retain all rights
API responses: Licensed to you for your use
Our IP: Algorithms and infrastructure remain our property

9.6 API Liability Limitations

Paid users:

Liability limited to fees paid in prior 12 months
No liability for indirect or consequential damages

Free tier: Service provided "as is" with no warranties

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time. We are not liable for any modification, suspension, or discontinuation of the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROMPT FIXER™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless The Prompt Fixer™, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to (a) your use of the Service in violation of these Terms, (b) your prompts or content, or (c) your infringement of third-party rights.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. AI-GENERATED SUGGESTIONS MAY NOT ALWAYS BE ACCURATE OR SUITABLE FOR YOUR SPECIFIC USE CASE. YOU ARE RESPONSIBLE FOR REVIEWING AND VALIDATING ANY PROMPTS BEFORE USE.

Output Use and Reliance: Outputs generated through the Service are provided for informational purposes only. Users are responsible for reviewing, validating, and determining the suitability of any output prior to use, deployment, or reliance.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

Content Monitoring: The platform does not actively monitor user prompts as a general practice. The platform may review, investigate, or remove content to comply with applicable law, enforce these Terms, or protect the integrity of the Service.

Termination Rights:

You: Cancel anytime (no refunds for partial months)
Us (for cause): 7 days notice for violations
Us (general): 30 days notice

Upon termination, API access ends immediately and data deleted within 30 days.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

16. Survival

Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution shall survive termination of these Terms.

17. Dispute Resolution

Except where prohibited by law or governed by a separate written agreement, disputes arising under these Terms shall be resolved through binding arbitration on an individual basis, and users waive any right to participate in a class or representative action.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
